Bizspoke Placement GmbH places great importance on protecting your personal data. BASIS FOR DATA PROCESSING

In many cases, processing your data is required for pre-contractual measures and/or contract fulfillment. Additionally, data processing may be based on consent declarations or legal obligations.

On our website, data is processed exclusively based on the legal provisions (GDPR, TKG).

The data processing is carried out in accordance with Art. 6 para. 1 lit. a) (consent) and b) (contract fulfillment) of the GDPR as well as § 96 para. 3 TKG.

If analytics tools are used, data processing is based on Art. 6 para. 1 lit. f) (legitimate interest) GDPR. The legitimate interest in data processing is to improve the website and measure the success of online advertising.

The use of IT security measures is also based on Art. 6 para. 1 lit. f) GDPR. The legitimate interest in data processing is to secure our IT systems.

PERSONAL DATA COLLECTED

Contact via Email, Phone, or Online Contact Form

We process the data you provide when contacting us solely to respond to your inquiry. Collecting your data is necessary to process your request, and you provide this data voluntarily. No automated decision-making or profiling is applied in this processing.

Your data is stored only for the duration necessary to fulfill the purpose. Beyond that, only the required data based on applicable legal obligations and retention requirements is processed.

Contractual Relationship

As part of customer management, we process the data you provide for contract execution in accordance with Art. 6 para. 1 lit. a GDPR. This includes, in particular:

  • Basic and contact details (e.g., name, address, email address, phone number, position, department)
  • Order data
  • Financial data

The personal data you provide is necessary for contract fulfillment or pre-contractual measures.

Within Bizspoke Placement GmbH, only those employees who require your data to fulfill contractual, legal, and regulatory obligations, as well as to protect legitimate interests, will have access to it.

Additionally, data may be transferred to third parties such as accountants, lawyers, insurance companies, banks, debt collection agencies, authorities, and, in specific cases, courts. Furthermore, commissioned processors (e.g., IT service providers) will only receive data necessary for fulfilling their contractual obligations. All processors are contractually obligated to process data only for the agreed purpose and to treat it confidentially.

Your data is processed for the duration of the entire business relationship (from initiation to execution and termination of a contract) and beyond, in accordance with legal retention and documentation obligations.

If no contract is concluded, the stored personal data will be processed for a maximum of one year.

Submission of Application Documents

By submitting your application, you agree that employees from the HR department and our coordinators may access your personal data. A simplified profile will be shared with our clients as a preliminary basis for decision-making regarding your application.

This simplified profile includes:

  • Name
  • Date of birth
  • Place of residence & postal code (but not your full address)
  • Education & qualifications

The legal basis for this is the fulfillment of contractual obligations (Art. 6 para. 1 lit. b GDPR).

If your application is successful, the necessary and relevant data will be further processed based on your employment relationship.

DATA PROCESSING

Please note that some data recipients may be located outside the EEA. In such cases, we only transfer your data to countries that have been certified by the European Commission as providing an adequate level of data protection or where appropriate legal agreements ensure data protection compliance.

DATA SHARING

Data transfers occur as needed to selected third parties (e.g., accountants, lawyers, banks, insurance companies, suppliers, authorities, and courts). Commissioned processors (especially IT service providers) will receive only the data necessary for their service provision. All processors are contractually bound to process data only within the scope of their services and in compliance with GDPR regulations.

We do not share your data with third parties for sale, exchange, or rental unless you have explicitly consented to such processing.

YOUR DATA PROTECTION RIGHTS

  • Right to Information: Individuals must be informed about data processing details and their rights.
  • Right of Access: You have the right to obtain information on which of your data has been stored and processed.
  • Right to Rectification: To prevent incorrect data usage, you can request corrections.
  • Right to Erasure (“Right to be Forgotten”): If data is no longer necessary, consent is withdrawn, or processing is unlawful, data must be deleted.
  • Right to Restriction of Processing: You can request temporary data restrictions during audits or legal claims.

DATA RETENTION PERIOD

We store your personal data as long as necessary for legitimate business and/or legal purposes, in line with this privacy policy, unless a longer retention period is required by law (e.g., for tax or accounting purposes).

If there is no legitimate reason for further processing, we will delete your data within three months.

Deletion of Applicant Data

If you do not consent to our extended applicant pool storage, your data will be automatically deleted within three months after the conclusion of the application process (e.g., rejection).

Consent for Extended Applicant Data Retention

By providing optional consent, your data will be kept in our applicant pool for potential future opportunities. In such cases, your data will be automatically deleted at the end of the following calendar year.

AUTOMATICALLY COLLECTED DATA
